Example of FDA disclaimer:

"The statements made regarding these products have not been evaluated by the Food and Drug Administration. The efficacy of these products has not been confirmed by FDA-approved research. We assume no responsibility for the improper use of our products. These products are not intended to diagnose, treat, cure or prevent any disease. All information presented here is not meant as a substitute for or alternative to information from health care practitioners. Please consult your health care professional about potential interactions or other possible complications before using any product. The Federal Food, Drug, and Cosmetic Act requires this notice"

A Mandatory THC disclaimer:

Example:

"Most workplace drug screens and tests target delta9-tetrahydrocannabindol (THC) and do not detect the presence of other legal natural hemp-based constituents. However, studies have shown that eating hemp foods and oils can cause confirmed positive results when screening urine and blood specimens. Accordingly, if you are subject to any form of drug testing or screening, we recommend (as does the United States Armed Services ) that you do not ingest our products. Prior to consuming these products consult with your healthcare practitioner, drug screening /screening/testing company, or employer. Our products are guarantee to contain less than or equal to 0.3% THC as demonstrate on the COA (Certificate of Analysis) found on each product page on our site"

Limitations by the state where the company is based:

  • California: No license needed but you CANNOT label the products as food or beverage
  • Florida: If you make/sell CBD consumables you need a food license
  • North Carolina: No smokable hemp & you need a license to sell living plants
  • Nevada: No CBD infused food
  • New Hampshire: No CBD infused foods
  • South Dakota: You require a license to sell
  • New York: You require a license to sell. Because we know the state is behind issuing these licenses, we will accept proof of application
  • Louisiana: You require a license
  • Utah: The law is very complicated we don't accept merchants from this state
  • Virginia: Cannot sell edibles

Shipping Limitations:

Cannot ship to NY, LA, or SD without the appropriate license. Kansas CBD must be 0% THC, if a site has products with more than 0% THC we will block shipping to Kansas.
